These Terms of Service ("Terms") govern your access to and use of hasmedia.com and related pages, content, and free resources (the "Site") operated by HasMedia ("HasMedia," "we," "us," or "our"). By accessing the Site or submitting your information, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
1. Who We Are
HasMedia is a personal branding and content marketing company. The Site provides information about our services and free educational resources, including downloadable materials and video content (the "Resources").
2. Use of the Site
You may use the Site only for lawful purposes. 4. Free Resources and Communications
Access to free Resources may require providing your name and contact information. By doing so you agree to receive communications from us as described in our Privacy Policy, and you may unsubscribe at any time. We may modify, replace, or discontinue any free Resource at any time.
5. Testimonials and Results Disclaimer
The Site displays real results, statistics, screenshots, and testimonials from actual HasMedia clients, published with their permission. These results are not typical and are not a promise or guarantee of your results. Follower growth, views, engagement, leads, and revenue depend on many factors outside our control, including your niche, effort, consistency, market conditions, and platform algorithms. We make no representation that you will achieve any particular outcome by using our Resources or engaging our services.
6. Not Professional Advice
Content on the Site and in the Resources is for general educational and informational purposes only and does not constitute legal, financial, tax, or other professional advice. You are responsible for your own decisions.
7. Client Services
Any paid services we provide are governed by a separate written agreement between you and HasMedia. In the event of a conflict between these Terms and a signed services agreement, the services agreement controls for those services.
8. Third-Party Services and Links
The Site may link to or integrate third-party sites, platforms, and tools (including social media platforms, video hosting, scheduling, and payment tools). We do not control and are not responsible for third-party content, policies, or practices. Your use of them is at your own risk and subject to their terms.
9. Disclaimer of Warranties
THE SITE AND RESOURCES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HASMEDIA AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR RESOURCES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR FREE RESOURCES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless HasMedia and its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Site or Resources or your violation of these Terms or applicable law.
12. Termination
We may suspend or terminate your access to the Site or Resources at any time, with or without notice, for any conduct we reasonably believe violates these Terms or is harmful to us or others. Sections 3, 5, 6, and 9 through 15 survive termination.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved exclusively in the state or federal courts located in New York, and you consent to their jurisdiction. You waive any right to participate in a class action to the extent permitted by law.
14. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the Site after changes take effect constitutes acceptance.
15. General
If any provision of these Terms is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy, are the entire agreement between you and HasMedia regarding the Site.
